If you purchase a subscription, you authorize the applicable payment provider to charge the fees associated with your selected plan.

3. Uploaded Content and Generated Outputs

When you use the Services, you may upload images, enter prompts, or submit other materials ("User Content"). The Services may enhance, transform, restore, upscale, or otherwise generate output based on that User Content ("Outputs").

  • You retain ownership of the User Content you upload.
  • To the extent permitted by law, you may use the Outputs you receive from the Services.
  • Because AI systems can produce similar results for similar inputs, Outputs may not be unique to you.

You are responsible for ensuring that your User Content and use of Outputs do not violate any law, infringe the rights of others, or breach these Terms.

4. License to Operate the Services

To provide the Services to you, you grant ImgUpscaler AI a non-exclusive, worldwide, royalty-free license to host, process, reproduce, modify, display, and transmit your User Content solely as needed to operate, maintain, secure, and improve the Services.

This license ends when your User Content is deleted from our active systems, except to the extent we need to retain limited information for security, legal compliance, backup, fraud prevention, or dispute resolution purposes.

5. Intellectual Property

The Services, including our website, branding, software, interface design, text, graphics, and related materials, are owned by or licensed to ImgUpscaler AI and are protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or otherwise exploit any part of the Services without our prior written permission.

6. Acceptable Use

You agree not to use the Services to:

  • upload, process, or generate content that is unlawful, abusive, defamatory, hateful, or fraudulent;
  • generate sexually explicit, pornographic, or NSFW content;
  • generate violent, gory, or dangerous content;
  • infringe copyrights, trademarks, privacy rights, publicity rights, or other rights of any third party;
  • upload malware, harmful code, or content intended to disrupt or damage the Services;

  • misuse subscriptions, credits, promotional offers, or account access, including account sharing or abusive automation;

Google, Nano Banana, and related marks are the property of their respective owners.

10. Disclaimers and Limitation of Liability
